TERMS AND CONDITIONS

1. GENERAL INFORMATION

Agropiesa.ro is the online store operated by DATUS SRL, a Romanian legal entity, with its registered office located in Drăgășani, 115 Primăverii Street, postal code 245700, registered for tax purposes and identified according to the records of the Trade Register under no. J1997000307381, with the unique registration code (CUI) RO 9497613.

By accessing, creating an account, or placing an order through the Website, you confirm that you have read, understood, and agreed to be bound by these Terms and Conditions.

2. DEFINITIONS

For the purposes of these Terms and Conditions, the following terms shall have the meanings set out below:

Seller

Refers to DATUS SRL, as well as any authorized commercial partner offering products through the Website.

Client

Any individual at least 18 years old who purchases parts for professional purposes, or any legal entity that accesses the site’s content.

User​

Any natural person over 18 years of age or legal entity who has created an account on the Website and accepted these Terms.

Buyer

A Client who places and completes an Order, thereby entering into a distance contract with the Seller.

Account

A secured section of the Website consisting of an email address and password, allowing the User to place Orders and access order history and related documents. Each person or legal entity may hold only one active Account and is responsible for the accuracy of the information provided.

Shopping Cart

A section within the Account where Users may add products for immediate or future purchase.

Favorites List

A feature allowing Users to save products for later viewing or potential purchase. Lists may be set as:

• Private – visible only to the Account holder
• Public – visible if shared

Website​

The online store accessible at  www.agropiesa.ro, including any subdomains or mobile applications.

Order

An electronic request submitted by the Buyer via the Website expressing the intention to purchase Products or Services.

Contract

The distance sales agreement concluded between the Seller and the Buyer, without physical presence of both parties.

Products and Services

Any goods or services made available for sale on the Website.​

Promotional Campaign​

A commercial initiative offering selected products for a limited time and/or within limited stock availability.

Content

Includes, but is not limited to:

•  information displayed on the Website​
•  product descriptions
•  electronic communications
•  promotional materials
•  newsletters and commercial messages

Unlawful Content

Any content that violates applicable laws or infringes third-party rights.

Review

A written opinion submitted by a Buyer regarding their personal experience with a product or service.

Rating

A satisfaction score expressed in stars (from 1 to 5) associated with a Review.

Comentariu

A request for information posted by a User regarding a specific product.​

Question

A request for information posted by a User regarding a specific product.

Answer​

A written reply provided in response to a Question on a product page.

Sale Price

The final price shown on the Website, excluding all applicable taxes.

Previous Price

The lowest price applied by the Seller within the 30 days prior to a price reduction, in accordance with applicable consumer protection laws.

Recommended Retail Price (RRP)

A reference price provided by the manufacturer or distributor. The Seller independently determines the actual Sale Price.​

Commercial Communications​

Any promotional or informational message sent via email, SMS, phone, or push notifications.

Safe Product

A product that, under normal or reasonably foreseeable conditions of use, does not pose risks to consumers.

Dangerous Product

A product that presents safety risks and may be subject to withdrawal or recall.

Withdrawal / Recall

A measure taken to remove a product from sale or from the market for safety reasons.

3. USE OF THE WEBSITE

Users agree to access and use the Website solely for lawful purposes. It is strictly prohibited to:

• engage in fraudulent activities
• publish illegal or misleading content
• interfere with the technical functionality of the Website

The Seller reserves the right to suspend or terminate Accounts in case of violations.

4. PLACING ORDERS

By submitting an Order, the Buyer confirms that:

• all provided information is accurate and complete
• the product specifications and pricing have been reviewed
• the chosen payment and delivery method is accepted

An automatic confirmation of receipt does not constitute acceptance of the Order. The Contract is concluded once the Seller confirms dispatch of the Products.

5. PRICING AND PAYMENT

All prices are expressed in Romanian lei (RON) or euros (EUR) and do NOT include VAT.

Accepted payment methods may include:​

• cash on delivery
• bank transfer

The Seller reserves the right to modify prices without prior notice; however, confirmed Orders remain unaffected.

6. DELIVERY

Products are delivered via authorized courier services to the address specified by the Buyer.

Estimated delivery times are indicative and may vary depending on stock availability and logistical factors.

7. RIGHT OF WITHDRAWAL

Consumers have the right to withdraw from the Contract within 14 calendar days from receipt of the Products, without providing any reason, in accordance with applicable EU consumer protection legislation.

Return shipping costs may be borne by the Buyer unless otherwise stated.

8. WARRANTIES

Products benefit from the legal warranty of conformity in accordance with Romanian and European legislation.

In case of non-conformity, the Buyer may request repair, replacement, or refund, as applicable.

9.  DATA PROTECTION

Personal data processing is carried out in compliance with Regulation (EU) 2016/679 (GDPR) and the Website’s Privacy Policy.

10. INTELLECTUAL PROPERTY

All Website content, including but not limited to text, images, graphics, and trademarks, is the property of DATUS SRL or its partners and is protected by intellectual property laws.

Unauthorized reproduction or distribution is prohibited.

11. LIABILITY

The Seller shall not be held liable for:

• improper use of Products
• inaccuracies provided by manufacturers
• delays caused by force majeure events or third-party service providers
